Terms of Service

1. Definitions

“Customer” means the real estate agent, broker or agency that uses or subscribes to Akary. “Authorized User” means a person the Customer allows to use its account or agency workspace (for example an agent invited with the agency code).

“Client” means a buyer, investor, seller or other person whose details are entered into Akary by or for the Customer. “Customer Data” means all information the Customer or its Authorized Users enter into Akary, including Client details, deals, listings, notes, logos and brochures.

2. The Services — and what Akary is not

Akary is a business-to-business software platform for real estate professionals in Dubai. It helps them analyse the market, compare projects, prepare branded reports, run purchase simulations, track deals and closing steps, manage listings and follow team performance.

Akary is a technology provider only. Akary is not a real estate broker or agency, a lender or financial institution, an investment, legal or tax adviser, a conveyancer or a valuer. The Customer remains solely responsible for its relationship with its Clients, for any representation made to them and for every transaction.

3. Accounts and Authorized Users

You must be at least 18, provide accurate information and use Akary for your professional activity. You are responsible for keeping login details confidential, for the access you give to Authorized Users, for their compliance with these Terms, and for telling us promptly at support@akary.ae if you suspect unauthorized access.

In an agency workspace, the director and managers can see and manage the deals of the agency, as described in the app.

4. Customer Data and your Clients

You keep full ownership and control of Customer Data. You grant us only the limited rights needed to host, process and display it in order to provide the Services. Your clients remain yours: Akary acquires no rights over your Clients, leads or transactions, and will never use Customer Data to contact or solicit your Clients.

You confirm that you have a lawful basis to collect your Clients’ details and to enter them in Akary, that you inform them and obtain consent where the law requires, and that you comply with the UAE Personal Data Protection Law and RERA rules. Our processing of Client data on your behalf is governed by our Data Processing Addendum (akary.ae/dpa).

You can export your clients at any time (Settings › Your data) and delete them from the app.

5. Market information, simulations and suggestions

Market figures, project information, yields, prices and rents come from public sources — including Dubai Land Department open data — and from our own calculations. They may be incomplete, delayed or estimated. Simulations are indicative only: final fees, financing terms and approvals are decided by the relevant authorities and institutions.

Suggestions shown in the app (for example the “next best action” of a deal or deals at risk) are rule-based aids to your own judgement. Nothing in Akary is investment, financial, legal or tax advice. Verify information before presenting it to a Client as fact or relying on it for a transaction.

6. Acceptable use

You will not use Akary for unlawful, misleading, fraudulent or infringing purposes; try to access other users’ data; probe, overload or disrupt the platform; copy, scrape, reverse engineer or resell the Services or their data; or share accounts with unauthorized persons.

Reports you send carry your branding. You are responsible for their use and for the advertising and licensing rules that apply to you, such as showing your RERA BRN/ORN where required.

7. Plans, trial, payment and taxes

Paid plans are billed in advance, monthly or yearly, through our payment provider (Stripe), at the price shown at checkout. Subscriptions renew automatically until cancelled. VAT or other taxes are added where applicable.

A free trial may be offered; nothing is charged during the trial. We may change prices for future periods with at least 30 days’ notice. A founding price stays locked for as long as the subscription remains active without interruption. Cancellations and refunds follow our Refund Policy (akary.ae/refund).

8. Intellectual property and feedback

Akary and its licensors keep all rights in the platform, software, design, databases compiled by Akary, methods, trademarks and documentation. You receive a limited, non-exclusive, non-transferable right to use the Services during your subscription.

If you send suggestions, we may use them freely to improve Akary, without naming you publicly without your permission.

9. Confidentiality

Each party protects the confidential information it receives from the other and uses it only to perform these Terms. This does not apply to information that is public, already lawfully known, independently developed or that must be disclosed by law.

10. Availability, changes and suspension

We work to keep Akary available and secure but do not guarantee uninterrupted or error-free service; maintenance and third-party infrastructure may affect availability. We may improve, change or remove features and will tell you in advance of any change that materially reduces a paid plan.

We may suspend access where reasonably necessary to protect security, investigate abuse or fraud, comply with law, address non-payment or prevent harm to the platform or other users — with notice where reasonably possible.

11. Disclaimer and limitation of liability

To the extent permitted by law, the Services are provided “as is” and “as available”. Akary does not guarantee any number of sales, conversion rate, financing approval, investment return, rental yield, price movement, completion of a transaction or availability of a property or project.

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or deals. Our total liability for all claims is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Termination and your data

You can stop using Akary and close your account at any time. We may close an account for material breach, unlawful use, fraud or persistent non-payment. After termination you can still request an export of your data for 30 days; we then delete it as described in our Privacy Policy, except what the law requires us to keep.

13. Data protection

Personal data is handled under our Privacy Policy (akary.ae/privacy) and, for Client data processed on your behalf, our Data Processing Addendum (akary.ae/dpa).

14. Changes to these Terms

We may update these Terms. We will announce material changes in the app or by email; for those, the app will ask you to accept the new version before you continue.

15. Governing law

These Terms are governed by the laws of the Emirate of Sharjah and the federal laws of the United Arab Emirates. The courts of Sharjah have jurisdiction, unless mandatory law provides otherwise.
